Terms of service

2.1 Eligibility:

You must be at least 18 years old to use the Service.

2.2 Subscription Plans:

The Service offers multiple subscription plans ("Plans"). Each Plan grants access to the Service for a specified number of websites. The "lifetime period" for each Plan is defined as a minimum of 5 years or until termination of the Service by us, whichever comes later. This means that once you subscribe to a Plan, you will have access to the Service for a minimum of 5 years. If the Service is terminated by us before the 5-year minimum period, you may be eligible to request a refund of any remaining subscription fees pro-rated for the unused period.

3.1 Content and Reviews:

Users may upload customer reviews, including text and images ("Content"). By uploading Content, you represent and warrant that you have obtained all necessary consents, licenses, and permissions from your customers to use and display their reviews and pictures on your website and through the Service.

3.2 Image Ownership:

You further represent and warrant that you own the rights to each image uploaded to the Service. In the event that you upload an image for which you do not hold the rights, you are solely responsible for any legal and financial consequences.

3.3 Compliance:

Users agree to comply with all applicable laws and regulations when using the Service.

4.1 Service Availability:

We strive to maintain the availability of the Service but do not guarantee continuous, uninterrupted access. There may be times when the Service is unavailable due to scheduled maintenance, upgrades, emergency repairs, network outages, or other unforeseen circumstances beyond our control. We will make reasonable efforts to notify users of any scheduled maintenance or downtime.

4.2 Modification of Service:

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. This includes but is not limited to changes in features, functionality, pricing, and availability. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service. If we make a significant change that negatively impacts your use of the Service, we will notify you in advance when possible.

4.3 Data Security:

We implement industry-standard measures, including encryption, firewalls, and secure server infrastructures, to protect user data from unauthorized access, disclosure, alteration, or destruction. While we strive to ensure the security of your data, we cannot guarantee absolute security. You acknowledge that any data you transmit through the Service is at your own risk. In the event of a data breach, we will notify affected users in accordance with applicable laws and regulations.

5.1 Termination by You:

As the Service is provided on a lifetime access basis, users do not have the option to terminate their account once a subscription is purchased.

5.2 Termination by Us:

We may suspend or terminate your access to the Service, at our sole discretion, for any reason, including but not limited to:

• Violation of these Terms or any other policies or guidelines related to the use of the Service.
• Engaging in fraudulent, illegal, or harmful activities.
• Providing false or misleading information.
• Engaging in activities that compromise the security or integrity of the Service or other users.

If we terminate your account, we will make reasonable efforts to notify you of the termination. In the event of termination by us, you may not be entitled to a refund of any fees paid, except as required by applicable law or as otherwise stated in these Terms.

5.3 Effect of Termination:

Upon termination of your account by us:

• All licenses and rights granted to you under these Terms will immediately cease.
• You must cease all use of the Service.
• Any data or content you have uploaded to the Service may be permanently deleted.
• Proofire is not liable to you or any third party for any termination of your access to the Service or deletion of your data or content.

5.4 Survival:

The provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, indemnity obligations, disclaimers, and limitations of liability, shall continue to apply even after termination of your account.

6.1 Payment:

Users agree to pay the applicable fees for the Plan selected. Fees are non-refundable except as required by law or as expressly stated. However, users are eligible for a full refund if requested within 7 days of purchase. Refunding the fees will result in termination of your account and access to the Service.

6.2 Taxes:

You are responsible for any applicable taxes related to your use of the Service.

7.1 Disclaimer:

To the extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2 Limitation of Liability:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
